Definitions - ‘Equipment’ means the items hired out by the Owner to the Hirer (YOU). ‘Hirer’ means any person who requested the Owner to hire equipment to it, including its employees and agents. ‘Owner’ means all Party Hire for Kids inc Suz Balloonz, ABN 33035249407, its employees and agents. ‘Terms’ means these Terms and Conditions.
The Owner - shall not be liable for damage or loss caused to any person, property, animal or things whatsoever, arising from the carriage, use or handling in anyway of the goods hereby hired even though such loss may result from negligence of the Hirer, its carriers, or agents and the customer will indemnify the Hirer in respect of any charges for such loss or damage. All prices are for one hire only, unless specified. A daily rate will be charged on all items returned after a specific date. All articles should be returned to the original drop-off point, clean and dry, otherwise additional charges will incur. If tables are placed in an area (either indoors or outdoors) where they get wet, the Hirer will forgo their entire bond. The customer is responsible for the goods hired from the time of their leaving the owner’s premises until their subsequent return. All damages and shortages occurring during that period are also the liability of the customer. This means that the customer will be liable for all additional costs of repairs. If goods go missing, they will be liable for the cost of new replacements. They will also be liable for any additional pick-up and delivery charges for “late or found” goods after the final pick-up has been made. Extraneous delivery and labour charges are additional. The Hirer is to check all goods upon delivery for number and conditions.
Please note – In case of bad weather (rain, hail, etc) – the Hirer (YOU) must provide suitable protective cover for all equipment. All equipment must remain dry – at all times. All equipment must remain undercover overnight. If tables are placed in an area (either indoors or outdoors) where they get wet, additional charges may apply. Table covers must be provided at all times, regardless of weather. If fabric tablecloths are used, a protective plastic tablecloth must be placed under the fabric cloth. Chairs are not suitable for any type of games such as Musical Chairs, etc. Marquees must not be used in strong winds, storms, etc.
Ball Pit Hire: Balls are to be returned to cloth bags provided by Hiree ready for collection at the agreed time, otherwise a $10 fee may apply. The Hiree is happy to disassemble the Ball Pit, however, if the Hiree requires the Ball Pit to be packed prior to the agreed collection time, this may be done by the Hirer (You) only if great care is given and the panels are not bent in any way. For safety purposes, food and drink is not to be consumed in the Ball Pit – at any time. All Ball Pits are strictly for use for children aged 1-2 years only and adult supervision is required – AT ALL TIMES. Full replacement value will be charged for any damaged panels ie. $30 per panel. The bond for the Large Size Ball Pit is $200.00. The bond for the Mega Size Ball Pit is $300.00.
Lolly Table Glassware: All items are chip free and are in excellent condition. The Hirer must check all items on delivery to agree to the condition of the items. The Hiree must remove all lids from the lolly table once the Lolly Table is ‘open for use’. If a lid, jar, canister is chipped, full replacement fee will apply. GLASSWARE IS NOT SUITABLE FOR THE USE OF CHILDREN – STRICT ADULT SUPERVISION IS REQUIRED.
The Owner may terminate the hire at any time. The Hirer shall have no claims for such termination.
Upon installation, delivery or collection of the Equipment, the Hirer should immediately examine the Equipment to satisfy itself as to its condition and suitability and fitness for the purpose to which it requires the Equipment and has satisfied itself as required.
The Hirer is to use the Equipment in a proper, safe and prudent manner and only for the purpose and capacity for which it was designed.
The Hirer to ensure all Equipment is returned or ready for collection by the Owner’s driver, in a ‘reasonably’ clean, dry state. The Hirer will pay for any excessive cleaning or drying costs and for any damage resulting from not properly drying, cleaning and/or packing the Equipment. The Hirer shall pay additional delivery/collection charges if all items are not available for collection at the agreed specified time.
The Hirer hereby releases the Owner from, and agrees to idemnify the Owner in respect of any third party claims, action, suits, demands, costs and expenses for damage or injury to person or property arising directly or indirectly out of the hire or use of the Equipment by the Hirer or these Terms.
If the Equipment is lost, breaks down or is damaged, the Hirer must immediately notify the Owner of the details. Notification shall not absolve the Hirer from its obligations under these Terms. In the event that the Equipment breaks down or becomes unsafe to use, the Hirer shall immediately stop using the Equipment and take all steps necessary to prevent the Equipment from sustaining any further damage. The Hirer must also take all steps necessary to prevent injuries from occurring to any person or property as a result of the condition of the Equipment and must not repair or attempt to repair the Equipment without the Owner’s prior written consent. If the act of the Hirer or the breach of any of these Terms by the Hirer, the Hirer shall without limitation be liable for the following; a) any costs incurred by the Owner in repairing or replacing the Equipment; b) hire charges for the Equipment until the Equipment is repaired or replaced; c) any other costs whatsoever incurred or loss suffered by the Owner as a result of the damage to or loss of the Equipment.
A $100-$300 bond is required for all bookings. Once the equipment is returned in a clean, dry state, the bond will be returned via direct bank deposit or by PayPal. If equipment is not returned reasonably clean, a $10 cleaning fee may be deducted from the Hirer’s (YOU) bond.
A non-refundable 50% deposit of the total is required for all bookings. The remaining 50% is required 5 business days prior to the function. If the balance is not paid by the due date the booking may be cancelled. Five business days prior to the party, all bookings are then finalised and no deletions or substitutions may occur, we are, however, happy to increase your order as required. If a booking is cancelled, all monies will be held until another booking can be made by (YOU) (price increases may occur and will be applied). Once the equipment is booked, the deposit paid can not be transferred to goods, such as balloons, party supplies, etc. Once the final payment has been made, all bookings are then final and may not be changed or deleted unless agreed by Hiree – additional costs may apply.
Note - We have a minimum order value of $80.00 for all table, chair and toy deliveries - not including delivery fee or bond. However, this amount may increase to $120 if distance travelled is over 60kms.
Every care will be taken to deliver balloons, decorations, etc. as ordered, however, if, unforeseeable circumstances occur, the Owner shall supply a similar product in its place.
Balloons – inhaling helium is extremely dangerous, and may result in death.
